1. Scope and acceptance

These Terms govern the use of the website castrodigital.net (the "Site") and the engagement of Castro Digital services (the "Agency"). By browsing or engaging, you fully accept these conditions.

2. Services

The Agency provides: web design & development, SEO optimization, digital marketing (Google Ads, Meta Ads, email marketing) and Google Business Profile management. Each project is governed by a specific commercial proposal and/or contract that prevails over these general terms.

3. Intellectual property

  • The Site's code, design, copy, and images are owned by Castro Digital or used under license. Reproduction without written authorization is prohibited.
  • Project deliverables (code, designs, content) become client property upon full payment, unless otherwise agreed in writing.
  • The Agency reserves the right to showcase completed projects in its public portfolio, unless an NDA is signed.

4. Client obligations

  • Provide accurate, complete, and timely information for proper project execution.
  • Grant necessary access (hosting, domain, Google accounts, social media) in due time.
  • Respond to validation requests, tests, and approvals within agreed timelines.
  • Not use the services for illegal activities, spam, phishing, malware distribution, or infringement of third-party rights.

5. Timelines and delivery

Timelines in the proposal are estimates and start upon receipt of all required materials and access. Delays attributable to the client (missing content, access, approvals) extend the timeline equivalently.

6. Pricing and payments

  • Prices are quoted in COP (Colombian pesos) or USD per proposal, VAT excluded unless stated.
  • Standard payment: 50% upfront, 50% on delivery. Other schemes by written agreement.
  • Late payment authorizes the Agency to suspend work and retain deliverables until regularized.

7. Warranties and limitation of liability

  • The Agency warrants deliverables meet agreed specifications and are free from material defects for 30 days after delivery.
  • No guarantee of specific search rankings, traffic volume, leads, or sales — SEO and marketing depend on external factors (algorithms, competition, market).
  • Total Agency liability for any claim shall not exceed the fees paid by the client for the relevant project.
  • The Agency is not liable for third-party server downtime, algorithm changes, third-party actions, force majeure, or data loss if the client fails to maintain backups.

8. Confidentiality

Both parties shall keep confidential all non-public information exchanged (credentials, strategies, business data) during the contract term and for 2 years thereafter.

9. Termination

Either party may terminate with 15 days' written notice. The client shall pay the proportional amount for work performed up to the termination date.

10. Governing law and jurisdiction

These terms are governed by Colombian law. Any dispute shall be submitted to the courts of Cali (Valle del Cauca), waiving any other jurisdiction.
